Pre-trial intervention (PTI) is a program in New Jersey designed to offer first-time offenders an alternative to the traditional criminal justice process. It is a voluntary program that allows eligible defendants to avoid the stigma of a criminal conviction by participating in rehabilitative services, supervision, and other court-ordered conditions. The primary goal of PTI is to rehabilitate and reform individuals rather than punish them, thereby reducing the likelihood of future criminal behavior.

These requirements may include drug or alcohol counseling, community service, restitution to victims, regular reporting to a probation officer, and other rehabilitative measures tailored to the defendant’s specific situation.

Successful completion of the PTI program results in the dismissal of the original charges. This outcome is highly beneficial as it allows the defendant to avoid a criminal conviction on their record, which can have long-lasting consequences on employment, housing, and other aspects of life. Furthermore, because PTI focuses on rehabilitation, it helps participants address underlying issues that may have contributed to their criminal behavior, thereby reducing the chances of reoffending.

If a defendant fails to comply with the program’s requirements, the case is returned to the court’s docket, and prosecution resumes as if PTI had never been granted. This can result in a trial, plea bargain, or other legal proceedings, leading potentially to a conviction and sentencing.
